Client care letter template and checklist

A client care letter tells a new client what you'll do, who will do it, what it's likely to cost and how to complain.

What is a client care letter?

The letter a solicitor sends at the start of a matter to confirm the work, who is responsible for it, how it will be charged and how to complain. It usually goes with the firm's terms of business, and the client often signs and returns a copy.

What must a client care letter include?

No rule says it has to be a letter. The SRA Code of Conduct for Solicitors does require you to tell clients in writing at the start how to complain, including about the Legal Ombudsman, and to give the best possible information about pricing and the likely overall cost.

Scope, who handles the matter and what you need from the client aren't named in the rules, but paragraph 8.6 expects clients to be able to make informed decisions, which needs them.

When should a client care letter be sent?

At the start, when you're engaged: complaints information in writing then, and costs information then and as the matter goes on. Sending it before substantive work starts lets the client raise scope and costs early.

If the estimate changes, tell the client. Paragraph 8.7 applies throughout the matter.

Do consumer clients have a right to cancel?

Yes, if the contract was made away from your office or at a distance, such as by phone or email. Under the Consumer Contracts Regulations 2013, a consumer can cancel within 14 days without a reason, and you shouldn't start work in that period unless they expressly ask.

If they ask you to start and then cancel, they may have to pay for work done so far.

Our costs

We will charge [a fixed fee of £[amount] plus VAT] or [£[rate] an hour plus VAT for [name] and £[rate] for [name]].

Our best estimate of the overall cost is £[amount] plus VAT, including [disbursements such as search, court or Land Registry fees]. We will tell you promptly if it is likely to change, and why.

We will bill you [monthly, at the end, or at these stages]. We may ask for money on account before we start or before particular steps.

Money we hold for you

Any money we hold for you is kept in our client account. [Set out your policy on paying interest on client money.]

If you are unhappy with our service

If you are unhappy with our service or our bill, please tell [name and role] at [email or address]. Complaints are free, and our procedure is [enclosed or at link].

If we have not resolved your complaint within eight weeks, you may be able to ask the Legal Ombudsman to look at it: usually within one year of the problem, or of when you found out about it, and within six months of our final response. See legalombudsman.org.uk.

How we are regulated

We are authorised and regulated by the Solicitors Regulation Authority, number [SRA number]. Its rules are at sra.org.uk. [Explain which work is regulated and the protections available, such as our professional indemnity insurance and the SRA Compensation Fund.]

What should you check before it goes?

Read it as the client will. The gaps that cause trouble later are easy to miss: no costs estimate, a scope that doesn't match what was agreed, or no Legal Ombudsman time limits.
